ICC Rules Former Philippine President Rodrigo Duterte Fit to Stand Trial

THE HAGUE, Netherlands — The International Criminal Court has ruled that former Philippine president Rodrigo Duterte is fit to stand trial, clearing a major procedural hurdle ahead of proceedings over alleged crimes against humanity linked to his anti-drug crackdown.

Trial Chamber III said it was satisfied that the 81-year-old can understand the charges against him, follow the course of the proceedings, grasp the evidence presented and instruct his lawyers in preparing his defense. The court added that he is able to effectively exercise his fair-trial rights, making him fit to stand trial.

Panel rejects defense health challenge

The ruling was based on reports from a panel of three medical experts appointed by the chamber in June. The experts submitted their findings in August after examining Duterte, and were unanimous in concluding that he retains the mental capacity needed to participate effectively in the proceedings.

While the experts observed physical and mental slowing consistent with his age and frailty, they found no reliable evidence of significant cognitive decline based on formal testing. Any possible cognitive impairment was described as mild, incipient or pre-clinical. The panel also noted an apparent improvement in his overall health since he arrived at the ICC detention facility, attributing it to the high standard of medical and nursing care there.

The chamber rejected the defense's requests for additional medical examinations and for an opportunity to question the court-appointed experts, finding the reports sufficiently clear.

Special accommodations ordered

To accommodate Duterte's age and health needs, the court ordered special measures during hearings, including hourly breaks, hearing aids or over-ear headphones, access to nursing staff and assistance with medication. His medical condition will continue to be monitored, with the possibility of a fresh fitness evaluation if his health changes.

Duterte faces three counts of crimes against humanity over alleged killings connected to the Davao Death Squad and his war on drugs, in which human rights groups have estimated nearly 30,000 people died. He was arrested in March 2025, becoming the first Asian former head of state taken into custody by the ICC. His trial is scheduled to open on November 30, 2026.
