Courts Must Not Impose Personal Morality While Deciding Bail, Rules Supreme Court

The Supreme Court has said that courts must refrain from imposing their personal views or value judgements on morality while deciding bail applications or criminal trials.

A bench of Justices Ujjal Bhuyan and Atul S. Chandurkar made the observation in an order passed on September 23, setting aside a Madhya Pradesh High Court order that had declined bail to an accused in a sexual assault case. The High Court had reasoned that granting bail could have ramifications on the social order and the "morals" of the victim's family — reasoning the apex court held to be impermissible.

The court's words

"We are of the view that courts should refrain from imposing the personal views or value judgement of the Presiding Judge on morality or otherwise while adjudicating a matter relating to bail, or even a criminal trial of an accused," the bench observed.

The Supreme Court emphasised that bail decisions must rest on established factors: the nature of the offence, the likelihood of the accused tampering with evidence or influencing witnesses, and the risk of absconding. "Imposing personal views on morality while deciding criminal cases is against principles of adjudication," the bench said, adding that cases must be decided strictly on the basis of law and facts, free from the presiding judge's subjective notions of morality.

Case background

The matter arose from a sexual assault case in Madhya Pradesh, where the accused had approached the apex court after the High Court rejected his bail plea. The court directed that the trial court impose appropriate conditions while granting bail to the accused.

The ruling, reported widely on September 30 and October 1, reinforces the principle that a judge's personal beliefs have no place in criminal adjudication — a significant statement for lower courts across the country.
